The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code.
As per allegations in the F.I.R., three accused persons on a motorcycle overtook the informant and on the point of revolver, dispossessed the informant of his mobile phone, Rs.7,000/ in cash, his motorcycle as also other articles mentioned in the F.I.R.
It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown. Referring to the order of the learned court below, it is submitted that from the contents of the order, it would transpire that the name of the
Patna High Court CR. MISC. No.16958 of 2021(2) dt.26-08-2021 2/2 petitioner transpired in course of investigation on the confessional statement of co-accused Bhogi Yadav made in another case and the said Bhogi Yadav has already been enlarged on bail vide order dated 15.12.2020 passed in Cr. Misc. no.28836 of 2020. The petitioner is in custody since 8.5.2020 and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the period in custody together with grant of bail to co-accused Bhogi Yadav on whose confessional statement made before police the name of the petitioner has transpired, the Court directs the petitioner to be enlarged on bail in connection with Arer P.S. Case no.7 of 2020 (corresponding to C.R.I. no.42 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Munsif-cum-Judicial Magistrate 1st Class, Benipatti.
