The petitioner seeks regular bail in connection with Gogari P.S. Case No. 316/2020, G.R. No. 2539/2020, instituted for the offence under Sections 147, 148, 149, 341, 323, 324, 332, 333, 307, 337, 338, 353, 504, 506, 224, 225, 427 of the Indian Penal Code.

As per prosecution case, the S.H.O of Gogari P.S. went to arrest one absconding accused at the village Bahadurpur and police arrested Rampukar Mandal. The police was surrounded by 39 F.I.R. named and 40-50 unknown accused persons who came with lathi, danda, stone and weapons and tried to extricate the accused and started assaulting the police party.

He further submits that there is general and omnibus allegation against the petitioner and the petitioner is the member of mob. Only they do not prevent the police to execute their duties. The petitioner is languishing in judicial custody since 22.11.2021 and several other accused persons have been granted bail by the co-ordinate Bench of this Court vide Annexure-2 series.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail application of the petitioner. Considering the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Supplementary Gogari P.S. Case No. 316/2020, G.R. No. 2539/2020.
