Heard both sides.
The petitioner apprehends his arrest in a case under section 307 I.P.C. and section 27 of the Arms Act.
The informant named the petitioner along with other co-accused persons and alleged that they all made indiscriminate firing. It is submitted that there is some dispute and nobody was injured in the occurrence.
It appears that firing was made and from the place of occurrence, empty cartridges were recovered.
Considering the facts and nature of allegation, I am not inclined to enlarge the petitioner on anticipatory bail and accordingly, the same is rejected.
The petitioner is directed to surrender in the court below and the court below shall consider the prayer for regular bail of the petitioner and dispose of the same on the same day taking into consideration that on account of firing made by the accused persons including the petitioner, nobody was injured (Prabhat Kumar Jha, J.) ahk/- U T
