The petitioners have preferred this application for grant of regular bail in a case registered under sections 307, 324 and other sections of the Indian Penal Code.

As per allegations in the FIR, the four named accused persons including the two petitioners herein are stated to have come and over a dispute relating to flow of water from the tap, it is stated that the petitioner no.1 assaulted the father of the informant with a dabia while the petitioner no. 2 assaulted the mother of the informant.

Patna High Court CR. MISC. No.16972 of 2021(2) dt.26-08-2021 2/2 It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in the case. The informant and the petitioners are neighbours and a civil dispute has been blown out of proportion. The injury on the father of the informant has been found to be simple in nature as per the injury report (Annexure-2). The petitioners are in custody since 30.11.2020 and have no criminal antecedents. Investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioners having remained in custody for over 8 months, the petitioners are directed to be enlarged on bail in connection with Madhepura P.S. Case no. 571 of 2020 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura.
