The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 109, 467, 468, 471, 472, 477(A), 409/120B of the Indian Penal Code as well as under Sections 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act, 1988.
The petitioner was Controller of Examination of J.P. University, Chapra. According to FIR, allegation is of misappropriation of fund released by the State Government for affiliated colleges under 'Vitta Sahit Rahit Siksha Niti', the scheme of the government. Considering the aforesaid facts, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance, North Bihar, Muzaffarpur/successor Court in connection with Special Case No.48 of 2016, arising out of Vigilance P.S. Case No.106 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
