JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-04-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 342, 365, 366A, 367, 370, 370a, 371, 376, 120B/34 and other ancillary sections of the Indian Penal Code and sections 3, 4, 6, 7 and 9 of the Immoral Trafficking Act.

Prosecution case is that this petitioner along with his wife are alleged to have engaged the informant and other minor girls for sexual exploitation/prostitution.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Informant is major and she in her statement recorded under section 164 Cr. P. C. has not supported the prosecution case rather she stated that the petitioner helped her. Petitioner has got no criminal antecedent.

Patna High Court CR. MISC. No.6158 of 2023(2) dt.11-04-2023 2/2 Considering the aforesaid facts of the case and 164 Cr.P.C. statement of the victim, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purna in Rauta Police Station Case No. 115 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
