Petitioners apprehend their arrest in a case registered for the offence punishable under sections 147, 149, 341, 342, 353, 332, 224, 504, 506 of the Indian Penal Code. Allegation against the petitioners is that they helped to escape the apprehended accused persons during the police raid and in the due course also hurt the police personnel and deterred them to discharge their duties.
Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.9249 of 2023(2) dt.12-05-2023 2/2 petitioners are not named in the FIR. There is general and omnibus allegation against these petitioners. Similarly situated co-accused persons, namely, (i) Gulab Raja, (ii) Md. Murtuja, (iii) Sahnaz Begum have already been granted bail by the coordinate Bench of this Court in Cr. Misc. No. 70073 of 2023. Petitioners claim clean antecedent.
Learned counsel for the State opposes the prayer of bail.
Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Punea in connection with K. Nagar (Srinagar) P.S. Case No. 493 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
