JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-04-2019 This is an application for grant of anticipatory bail in connection with Birpur P.S. Case No. 101 of 2018, disclosing offences under Sections 467, 468, 471, 420, 120(B)/34 of the Indian Penal Code.
Allegation against the petitioner is of getting job on the basis of forged mark-sheet and certificates. Submission of learned counsel for the petitioner is that he has already suffered a lot and has also been terminated from the service. Further submission is that several other accused persons have been granted privilege of anticipatory bail on similar circumstances including one of the co-accused, who has been granted provisional anticipatory bail vide order dated
Patna High Court CR. MISC. No.7050 of 2019(3) dt.03-04-2019 2/2 26.03.2019 passed in Cr. Misc. No.16860 of 2019. Heard learned APP as well as learned counsel for the vigilance.
Having heard both sides, in view of the facts and circumstances of the case as stated above, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender before the court below within a period of six weeks and make prayer for regular bail, which will be considered on the basis of materials available on record and also considering the fact that others have been granted anticipatory bail and if possible, to be disposed of on the same day.
