Petitioners in the present case are own brothers of the informant. They are seeking anticipatory bail in connection with Bakhtiyarpur P.S. Case No. 263 of 2015 registered for the offences punishable under Sections 341, 323, 379, 354(B), 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are living separately from the informant and are engaged in their own business and government job. There is a land dispute between the parties and on account of that the present FIR has been lodged falsely implicating these

Patna High Court CR. MISC. No.11926 of 2019(2) dt.28-02-2019 2/2 petitioners. It is also submitted that there is no injury either to the informant or his wife.

Learned APP for the State is present and has opposed the prayer for bail.

Considering the facts and circumstances of the case, relationship between the parties and the submission that there is a land dispute as also that the petitioners are living separately, in case of arrest or surrender of the petitioners within a period of four weeks from today, the abovenamed petitioners shall be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) each with two sureties of the like amount each to the satisfication of the learned Chief Judicial Magistrate, Saharsa in connection with Bakhtiyarpur P.S. Case No. 263 of 2015, subject to the condition that petitioners shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation. This will be in addition to condition prescribed under Section 438(2) of the Cr.P.C.
