Petitioner seeks bail in a case registered under sections 115, 120B of the Indian Penal Code and sections 25 (I-B) a, 26, 35 of the Arms Act.

Petitioner and two others were caught by the police while they were going on motorcycle and two live cartridges are said to have been recovered from the conscious possession of the petitioner. So far as rest accused are concerned, it is stated that firearms were recovered from their respective possession.

On interrogation, petitioner disclosed that he as well as others had come to commit murder of one Mukhiya. Submission on behalf of the petitioner is that petitioner does not have any criminal antecedent and, as a matter of fact, he has been

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Bhagalpur in Shahkund P.S.
