1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Dehri-on-sone RPF Case no. 18 of 2023 registered under section 3 of the R.P. (UP) Act.

3. As per the prosecution case, the informant states that a truck loaded with railway property was recovered in front of the shop of this petitioner. Various properties as mentioned in the seizure list enclosed with the F.I.R was recovered.

4. Learned counsel for the petitioner submits that no incriminating article has been recovered from the petitioner's possession or from his shop. He has been falsely implicated in

Patna High Court CR. MISC. No.8641 of 2024(2) dt.20-02-2024 2/2 the case because of one antecedent of the year 2015. He has no concern either with the truck in question nor with the article seized there from. He is in custody since 5.11.2023 and chargesheet has been submitted in the case.

5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R, his having remained in custody for more than 3 months since 5.11.2023 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Dehri-on-sone RPF Case no. 18 of 2023, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Railway Judicial Magistrate- 1st Class, Gaya.
