The petitioners are languishing in custody since 27.04.2014 in a case registered for the offences punishable under Section 395 of the Indian Penal Code.
The accusation is of committing dacoity in the house of the informant and in the house of the neighbour of the informant. The petitioners were identified by the informant. It is submitted by learned counsel for the petitioners that the petitioners are co-villagers of the informant and due to the dispute from before the accusation has been levelled, though, subsequently the informant has retracted from the initial version and filed a petition to that effect before the learned court
Patna High Court Cr.Misc. No.32908 of 2014 (03) dt.09-01-2015 2/2 below. Moreover, there is no recovery from the petitioners. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Muzaffarpur in connection with Gaighat P.S. Case No. 143 of 2014.
