JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04.04.2016 Heard learned counsel for the petitioner, learned Addl. Public Prosecutor for the State as well as learned counsel for the informant.

Petitioner seeks bail in a case registered under section 420/34 of the Indian Penal Code.

Petitioner is said to have taken Rs 3, 91, 000/- from the informant in the name of execution of the sale deed and subsequently, he executed sale deed in favour of the petitioner but when the informant verified, it was found that the land in question was not stood in the name of the petitioner.

Petitioner is in jail custody since 4.9.2014 and report of Sri Shymal Kumar, Judicial Magistrate, Ist Class, Danapur shows that up till now, charge could not be framed against the petitioner. Furthermore, the aforesaid report of the learned Judicial Magistrate does not reveal what happened to the main record of Dulhin Bazar

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Shymal Kumar, Judicial Magistrate, Ist Class, Danapur/ concerned court in Dulhin Bazar P.S. Case no. 09/2013.
