The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420, 120B/34 of the Indian Penal Code.
The prosecution case is that the accused persons negotiated with the purchase of old semi rice mill of the informant on 10.10.2014. On 12.10.2014 part money was given to the informant and the balance amount of Rs. 1,50,000/- was to be given by the accused persons. Subsequently, the petitioner Raju Ranjan Kumar issued a cheque of Rs. 1,50,000/- which got bounced.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.24096 of 2016 (2) dt.30-05-2016 petitioner that First Information Report has not been registered under Section 138 of the Negotiable Instrument Act and in a contractual nature of accusation the First Information Report has been lodged. The father of the petitioner Munilal Singh has been granted bail by a Coordinate Bench of this Court vide Cr. Misc. No. 2045 of 2016.
Considering the nature of accusation, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram, Rohtas in connection with Sasaram (Nagar) P.S. Case No. 772 of 2015, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
