1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Pauthu P.S. Case no.78 of 2022 registered under sections 25(1-B)(a) and 26 of the Arms Act.

3. As per the prosecution case, on the confessional statement of co-accused Manish Kumar, it is stated that the straw roof house of the petitioner was raided from which a country made rifle and two live cartridges was recovered.

4. Learned Senior counsel appearing for the petitioner submits that no incriminating article has been recovered from the petitioner's possession who has been falsely implicated in the case. In any case, the alleged place of recovery is an open

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the F.I.R. and his being in custody since 28.11.2023, the Court directs the petitioner to be enlarged on bail in connection with Pauthu P.S. Case no.78 of 2022 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad.
