====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 13-05-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. In the present case, the petitioner seeks bail in connection with Katra P.S. Case No. 77 of 2024, registered for the offences under Sections 304(B)/34 of the Indian Penal Code.

3. As per the prosecution case, the sister of the informant was married with the son of the petitioner in April, 2023. The sister of the informant died in her matrimonial home on 04.05.2024 and allegation against petitioner and other coaccused persons is that of demanding Rs.2,00,000/- and gold and silver.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. No occurrence in the manner as alleged has ever taken place. The daughter-in-law of the petitioner committed suicide as she was depressed. Perusal of

The informant also came to visit his sister on 04.05.2024 and found her dead and on suspicion he has falsely implicated the petitioner and other coaccused persons. The petitioner and his family members never demanded any dowry nor subjected the deceased to any torture. The petitioner is even separate in mess and business from the husband of the deceased and has no direct concern with their domestic affairs. Learned counsel further submits that petitioner has no criminal history and he is in custody since 18.11.2024. Charge sheet has been submitted.

5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner. Learned A.P.P. submits that petitioner is father-in-law and is named along with other co-accused persons for being involved in the dowry death of his daughter-in-law.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the fact that petitioner is father-in-law of the deceased and further considering non-specific nature of allegation and possibility of deceased committing suicide and also considering the submission of charge sheet against the petitioner and period of

No.6135 of 2025(3) dt.13-05-2025 3/3 custody, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned J.M., 1st Class, Muzaffarpur/concerned court, in connection with Katra P.S. Case No. 77 of 2024, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
