The petitioner is languishing in custody for the offences punishable under Sections 147/148/149/ 307 /379 / 506/326 of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner is in custody since 23.12.2017. Allegation is that he caused fire-arm injury at the right thigh of the informant for trivial dispute arising out of filling of the drainage system by the petitioner-side.
Earlier the prayer for bail was refused on 05.04.2018 with direction to the learned trial Judge to conclude the trial preferably within nine months and liberty to the petitioner to
Patna High Court CR. MISC. No.12465 of 2019(2) dt.08-05-2019 2/2 renew the prayer, if the trial is not concluded, within the aforesaid period. Trial is still pending.
Considering the period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bachhwara P.S. Case No.35 of 2017, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
