JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-06-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in connection with Kashichak P.S. Case No. 101 of 2019 for the offenses under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

In the instant case 202 liters of liquor is alleged to have been recovered near a maize field.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The liquor was seized from a place near the maize field. The petitioner is residing in a village 14 KMs away from the place where the liquor was seized. There is absolutely no material to connect the petitioner with the trade of liquor.

No.9238 of 2020(3) dt.10-06-2020 2/2 Considering the fact that the petitioner has no criminal antecedent and he is residing 14 KMs away from the place where the liquor was seized, the court is inclined to grant bail to the petitioner. Let the petitioner, above named, in the event of arrest or surrender before the court below within a period of four weeks, be enlarged on anticipatory bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum- Special Judge (Excise Act), Nawada in connection with Kashichak P.S. Case No. 101 of 2019, subject to the condition that on release the petitioner shall render his services as volunteer to combat the pandemic of Covid-19 for a period of one month. He is required to report to the Civil Surgeon/ Nodal Officer, Covid-19, Nawada, who shall utilize his services appropriately.
