JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-01-2015 Heard learned counsels for the petitioner and the State. The petitioners are languishing in jail since 05.05.2014 and 31.03.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 302, 427 and 504/34 of the Indian Penal Code and Section 27 of the Arms Act.
It is alleged that the accused persons were grazing the vegetable crop of the informant and when the informant raised objection, on the order of petitioner Raj Kumar Yadav, co-accused
Patna High Court Cr.Misc. No.33229 of 2014 (4) dt.09-01-2015 2/2 Ballo Yadav @ Prithvi Yadav and Sheetal Yadav caused firearm injury on the thigh of Pinkesh Yadav, subsequently, all the accused persons dragged the victim who subsequently, succumbed to the injuries.
It is submitted by learned counsel for the petitioners that the accusation of causing firearm injury is not against the petitioners.
Though, the petitioner Ram Kumar Yadav is accused in one other case and petitioner Ram Pukar Yadav is accused on two other cases but since the accusation of firing is not against them, let the above named petitioners, be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Mufassil) P.S. Case No. 36 of 2014.
