JUSTICE SATYAVRAT VERMA ORAL ORDER 22-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through the virtual Court proceedings. Let the defect(s), if any, be removed within a period of four weeks.
The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 332, 333, 337, 338, 353 of the Indian Penal Code, Section 45 of the Bihar Prohibition and Excise (Amendment) Act, 2018 and Sections 3 and 4 of the Damage to Public Property Act. The informant alleges that on receiving information that one Anup Ram an accused had come to his house at Sishrarh, the police reached the place of occurrence and Anup Ram was arrested by the police. In the meantime, it is alleged that 22 named accused persons including the petitioner and 50-60 unknown formed a mob and attacked on the police party and also pelted stones on account of which Anup Ram managed to escape from the police custody.
Patna High Court CR. MISC. No.6317 of 2022(3) dt.22-07-2022 2/2 Submission is that though the petitioner is named in the FIR but there is no specific allegation against him. The allegation is general and omnibus in nature and even the injuries of the injured are simple in nature. He further submits that petitioner is a person with clean antecedent and is a young man of 25 years of age. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
Considering the aforesaid submissions, let the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Rajpur P.S. Case No. 111 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
