Mr. Umeshanand Pandit,APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-03-2025 Heard Mr. Bhavesh Kumar, learned counsel for the petitioners and Mr. Umeshanand Pandit learned A.P.P. for State.

2. The petitioners apprehend their arrest in a case registered for the offence under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 109, 303(2), 324(2), 352, 351(3) of the Bhartiya Nyaya Sanhita.

3. As per the prosecution case, on 31.10.2024 at about 9:30 PM, while the informant alongwith his friend was returning home, all the F.I.R. named accused persons including these petitioners surrounded them, started beating informant and snatched a gold chain & cash of Rs. 10,000/- from the informant and when informant's friend came objected, on the order of petitioner no. 1 (Shatrughn Mahto), co-accused Mithilesh assaulted him with Paghariya and petitioner no. 2 assaulted on

Patna High Court CR. MISC. No.6574 of 2025(2) dt.03-03-2025 2/2 his head with iron rod. It is further alleged that co-accused Bharat assaulted informant with butt of pistol on his head, whereas other co-accused persons damaged his motorcycle.

4. Learned counsel for the petitioners submits that both parties are co-villagers and due to political rivalry, this false and concocted case has been lodged. There is no allegation of assault against these petitioners. He further submits that the injury, allegedly caused by petitioner no. 2, is simple in nature. Petitioners claim clean antecedent.

5. Learned A.P.P. has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Warisnagar P.S. Case No. 268 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
