JUSTICE PRABHAT KUMAR JHA ORAL ORDER 13-01-2015 Heard learned counsel for the petitioner, learned counsel for the State as well as learned counsel for the informant. The petitioner seeks bail in Udakishunganj P.S. Case No. 179 of 2013, registered for the offences punishable under Section 420 and other Sections of the Indian Penal Code.

The informant Vikash Kumar Yadav @ Lalu Prasad Yadav filed a complaint case bearing no. 1080 of 2013 thereupon the present case was registered. The informant made allegation that the petitioner has opened a bank in which the informant and others deposited money. The informant and others have also received pass books.

Learned counsel for the petitioner submits that the petitioner has not opened any bank nor issued any pass books. The petitioner has got dispute with the informant for purchasing of truck.

No.34314 of 2014 (3) dt.13-01-2015 Even during the course of investigation, the supervising authority found that the wife of the petitioner runs a society in the name of Bihar Rural Development Women Self Help Groups and she was the Secretary of that society who use to collect money and deposit in Udakishunganj North Bihar Rural Bank A/C No. 1007791030008618. On the other hand, learned counsel for the informant while opposing the prayer for bail has submitted that the informant and many others were issued pass books and they deposited money but failed to produce the signature of the petitioner on the pass books. It is submitted that the petitioner has employed his own men for issuance of pass books.

Having considered the facts aforesaid and the fact that the petitioner denied to have issued any pass books or open any bank for collecting money from different persons and there is no documentary evidence to show that the petitioner had opened any bank and the petitioner is in jail since 17.06.2014, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Udakishunganj P.S. Case No. 179 of 2013.
