Petitioner seeks bail in a case registered under sections 302, 394 of the Indian Penal Code as well as section 27 of the Arms Act. Petitioner is not named in the first information report but in course of investigation, one co- accused Sanni Kumar was arrested and confessed his guilt disclosing this fact that the petitioner was also involved in conspiracy and gave hint to other accused prior to the alleged occurrence. Even if the confessional statement of co- accused assumed to be true, then also, petitioner has not taken any active part in committing the alleged crime.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial
