The petitioner has approached this Court seeking direction to the authority concerned to make available the lower court record of Title Suit No. 40 of 1986/09 of 1993 disposed of vide judgment and decree dated 25.02.1994 by the court of learned Additional Munsif-II, Aurangabad to the Appellate Court where Title Appeal No. 09 of 1994 is pending against the aforesaid judgment and decree.

3. Learned counsel for the petitioner submits that the matter is quite old and due to non-availability of the lower court record of Title Suit No. 40 of 1986/09 of 1993, the appeal could not be disposed of though it is of the year 1994.

Since the petitioner has approached this Court with limited prayer, learned District Judge, Aurangabad is directed to look into the matter and ensure that the lower court record of Title Suit No. 40 of 1986/09 of 1993 is made available to the court in seisin the matter of Title Appeal No. 09 of 1994 at the earliest and send a report to this Court within three months about making available the lower court record of Title Suit No. 40 of 1986/09 of 1993 to the learned Appellate Court.

5. With the aforesaid direction, the present petition stands disposed of.
