2. The present application has been filed for setting aside the order dated 18.01.2017 passed by the learned District Judge, Rohtas, Sasaram by which the prayer of the petitioner for transfer of the T.S. No. 478 / 2001 from Sub-division, Bikramganj to the Civil Court at Sasaram was refused.

3. Learned counsel for the petitioner submits that the disputed property involved in Title Suit No. 478 of 2001 is situated in Circle Kochas which is under the jurisdiction of

Patna High Court C.Misc. No.1296 of 2017(2) dt.20-07-2023 2/2 District Court, Rohtas at Sasaram but the Sheristadar has given report on the basis of police station and not on the basis of circle and accordingly, this case may be disposed of with the liberty to the petitioner to file a fresh application before the District Judge, Rohtas, Sasaram.
