2. The petitioner is in custody in a case registered for the offence punishable under Sections 399, 402, 324, 326, 332, 333, 307, 352 and 353 of the Indian Penal Code and Sections 25(1-B)a, 26, 27 and 35 of the Arms Act.
3. According to the FIR, when the informant along with police personnel were on patrolling duty, a vehicle was trying to escape after seeing them. When police tried to caught them a clash broke out between the accused and the police. Ultimately, the accused persons have been arrested.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.11462 of 2025(3) dt.13-05-2025 2/2 petitioner has falsely been implicated in this case. He next submits that the petitioner was neither arrested on the spot nor anything has been recovered from his possession and the name of the petitioner surfaced on the basis of confessional statement of co-accused Rajan Tiwary in police custody. He next submits that similarly situated co-accused persons have been granted regular bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 21270 of 2024 and he is in custody since 22.04.2024.
5. Learned APP for the State opposes the prayer for regular bail of the petitioner.
6. In view of the aforesaid facts and circumstances as well as the fact that similarly situated co-accused has been granted regular bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 21270 of 2024 and petitioner is in custody for more than one year, so let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, East Champaran at Motihari in connection with Chakiya P.S.
