The petitioner apprehends his arrest in connection with Raghopur P.S. Case No. 142 of 2019 registered for the offences punishable under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that there is recovery of 43.50 litres of foreign liquor from the half-built house of the petitioner. He further submits that there is no recovery from the conscious possession of the petitioner and the petitioner has no criminal antecedent.
In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner, subject to the condition that the petitioners is agreed to deposit Rs. 10,000/-
Patna High Court CR. MISC. No.9341 of 2020(2) dt.29-02-2020 2/2 (Ten Thousand) in the Juvenile Justice Fund of the State Social Welfare Department and on deposit of the aforesaid amount, in the event of his arrest or surrender before the court below within six weeks from the date of communication of this order, the court below shall release him on bail on furnishing bail bonds of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge, Excise, Vaishali at Hajipur in connection with Raghopur P.S. Case No. 142 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
