In this case, the petitioners are seeking bail in connection with Kanti P.S. Case No. 626 of 2019 registered for offence punishable under Sections 147, 148, 149 and 302 of the Indian Penal Code.

The allegation against the accused persons including the petitioners is to have killed the father of the informant by firearms by hatching conspiracy, however, counsel for the petitioners submits that there is no eye witness to the occurrence and there is no material available in the case diary to indicate involvement of these petitioners in the commission of

Patna High Court CR. MISC. No.8114 of 2020(4) dt.12-08-2020 2/2 the occurrence. It has further been submitted that similarly situated other co-accused persons have already been granted bail by a coordinate Bench of this Court vide order dated 28.05.2020 passed in Cr. Misc. No. 4697 of 2020.

Considering the facts and circumstances of the case, the petitioners, above-named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, West, Muzaffarpur in connection with Kanti P.S. Case No. 626 of 2019 with a condition that whenever the police will call the petitioners for the purposes of investigation and interrogation, they will remain present for the investigation. In the event of being absent on two consecutive dates without reasonable explanation, the present order will be treated to have been cancelled.
