Petitioner seeks bail in a case registered for the offence punishable under Sections 328, 302, 34 of the Indian Penal Code.

Allegation against the petitioner is to have administered poison to the father of the informant and also hit him with bricks on his head as a result of which, he died. It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case. Petitioner has no criminal antecedent and he is in custody since 5.10.2018.

Considering the facts of the case and nature of allegation, I am not inclined to enlarge the

Patna High Court CR. MISC. No.10363 of 2019(3) dt.14-03-2019 2/2 petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is hereby rejected.

However, it is observed that the petitioner may renew his prayer for bail after completing one year in custody. (S. Kumar, J) Sanjay/- U T
