JUSTICE HARISH KUMAR ORAL JUDGMENT Date : 29-07-2024 Heard Ms. Rashmi Sandhwar, learned Advocate for the petitioner, Ms. Meeta Sinha, learned Advocate for the Municipal Corporation, Munger and the learned Advocate for the State.

2. The wife of the petitioner died in harness on 17.03.2020, while working as a 4th Grade Employee (Ward Jamadar) under the Munger Municipal Corporation. Despite her untimely death way back in the year 2020, when the petitioner has not been accorded the terminal dues of her wife, he approached before this Court by filing the present writ petition.

3. Learned Advocate for the petitioner fairly submitted that during the pendency of the writ petition, the petitioner has been paid all the admissible terminal dues, except

Patna High Court CWJC No.1872 of 2022 dt.29-07-2024 2/2 arrears of differential amount of 5th Pay Revision as well as 6th Pay Revision. However, the petitioner has later on paid one year of the differential amount of 6th Pay Revision.

4. Learned Advocate for the Municipal Corporation referring to the counter affidavit categorically stated that the amount of 6th Pay Revision for one year has already been paid to all the concerned retired or deceased employees of municipal corporation and bill for another one year is prepared for its payment and the same shall be disbursed within a short span of time.

5. Considering the submissions of the learned Advocate for the respective parties, the present writ petition stands disposed of with a direction to the respondent nos. 3 and 4 to consider the claim of the petitioner and ensure payment of remaining admissible dues of 5th and 6th Pay Revision, preferably within a period of twelve weeks from the date of receipt/production of a copy of this order.

6. The writ petition stands disposed of with the aforesaid direction.
