This application for grant of Regular bail arises out of Keshariya P.S. Case No. 72 of 2016, disclosing offences under Sections 25(1-b)/a/26/35 of the Arms Act.
Petitioner is in custody since 10.03.2016. He was arrested alongwith co-accused Hukum Sahani. Four live cartridges are said to have been recovered from the possession of the petitioner and from the possession of co-accused Hukum Sahani, one loaded country made pistol was recovered. Considering the fact that from the petitioner's
Patna High Court Cr.Misc. No.23038 of 2016 (2) dt.25-05-2016 2/2 possession only four live cartridges are alleged to have been recovered, this application is allowed.
Let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., XI, Motihari, in Keshariya P.S. Case No. 72 of 2016. This is subject to the condition that the petitioner shall present himself before the police/court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutives occasions, his bail bonds shall be liable to be cancelled.
