In the present case, the petitioner is seeking bail in Powakhali P.S. Case No. 39 of 2019 registered for offence punishable under Sections 363, 366, 366A, 376, 120 (B)/34 of the Indian Penal Code and Section 4 of POCSO Act. The allegation against the co-accused including the petitioner is to have kidnapped the daughter of the informant and committed rape upon her, however, counsel for the petitioner submits that from perusal of different paragraphs of case diary, it appears that the girl has love affair with one coaccused Kairul Khan and she fled away along with Kairul Khan inasmuch as they have entered into the marriage. It is urged that the said co-accused Kairul Khan has been granted bail by a Bench of this Court vide order daed 18.01.2020 passed in Cr.

Patna High Court CR. MISC. No.4260 of 2020(6) dt.25-09-2020 2/2 Misc. No. 76418 of 2019 and the petitioner is in custody since 31.10.2019. It is claimed that his antecedent is clean. Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-I-cum-Special Judge, Kishanganj in connection with Case No. Powakhali P.S. Case No. 39 of 2019.
