The petitioner is languishing in custody since 25.11.2018 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The prosecution case is to the effect that from the motorcycle of the petitioner, 1.47 litres of illicit foreign liquor was recovered.

It is submitted by learned counsel for the petitioner that recovery is of small quantity. A statement has been made in paragraph no.3 of the petition that the petitioner is involved in two other cases of similar nature of offence. Learned APP submits that recovery has been made from

Considering the quantity of recovery, period under custody and the fact that investigation has already been concluded, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned ADJII,Saharsa. in connection with Special (Excise) Case 533 of 2018, arising out of Mahishi P.S.
