Petitioner seeks bail in Majorganj P.S. Case No.370 of 2018 instituted for the offence under Section(s) 302/34 Indian Penal Code and Section 27 of the Arms Act.
Counsel for the petitioner submits that in the written report specific allegation of causing firearm injury to brother of the informant is against co-accused Vikash Kumar Singh. In the written report, it is alleged that informant was going on motorcycle with his brother. When he reached near Narha Bazar, four persons arrived on two motorcycles. One motorcycle was being driven by Manish Kumar on which Vikash Kumar Singh was sitting. Vikash Kumar Singh, who had criminal antecedents, had fired from his pistol on his brother,
Patna High Court Cr.Misc. No.2765 of 2019(2) dt.22-01-2019 2/2 Nikhil Kumar Singh, in his abdomen. He fell down and became unconscious. Later on, he was declared dead in Sitamarhi Sadar Hospital.
As such, there is specific allegation against coaccused, Vikash Kumar Singh, of causing firearm injury to brother of the informant.
Petitioner is in custody since 21.09.2018 having clean antecedents.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, 1, Sitamarhi, in connection with Majorganj P.S.
