The petitioner is in custody since 27.05.2015 in a case registered for offences punishable under Sections 413/414 of the Indian Penal Code.
The prosecution case is that the informant, who is S.H.O., got secret information that the petitioner is moving with a stolen motorcycle and when on this information, raid was made by him then splendor pro motorcycle was recovered from the possession of the petitioner vide registration no- WB01AT/1458 and on demand of the paper nothing has been shown by the petitioner, thereafter in presence of witnesses, seizure list was prepared and the instant case was lodged.
Patna High Court Cr.Misc. No.33648 of 2015 (2) dt.19-08-2015 2/2 Learned counsel for the petitioner has submitted that the petitioner is innocent and he has been falsely dragged in this offence. It has also been submitted that the vehicle in question has been recovered from the hut of one Adalat Ram, where he works as servant.
In view of the facts and circumstances, let the petitioner, namely, Pankaj Kumar Thakur be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Siwan in connection with Bhagwanpur P. S. Case No. 94/2015.
