2. The petitioner is apprehending arrest in connection with Complaint Case No. C1-151/2021 dated 02.06.2021, for the offence punishable under Sections 341, 323, 420, 452, 498(A), 406, 506, 504 & 34 of the IPC and D.P Act.

3. Learned counsel for the petitioner submits that notice has been issued upon the complainant/O.P. No.2 under speed post with A/D as well as through ordinary process which has been served, but even then, O.P. No.2 has not appeared. Counsel submits that marriage was solemnized and thereafter, O.P. no.2 has filed one case under section 498(A) of the IPC

Patna High Court CR. MISC. No.6390 of 2025(3) dt.09-05-2025 2/3 against the petitioner which is still pending and compromise was filed but subsequently, the present case has been filed in which cognizance has been taken under Sections 323, 498(A) & 34 of the IPC. Counsel submits that the petitioner is doing private job outside the state i.e. in Andhra Pradesh. Counsel further submits that petitioner has lodged a Matrimonial Case No.117/2020 against the complainant and later on, when she got information about this, then in retaliation, she has filed the present case as false and fabricated against the petitioner. Counsel submits that the petitioner is a law abiding citizen and ready to fulfill all the conditions whatsoever shall be imposed upon him. Counsel for the petitioner himself offered payment of Rs.3,000/- (Rupees Three Thousand) per month to the complainant.

4. Learned APP for the State opposes the prayer for bail of the petitioner but submits that petitioner is ready to pay Rs.3,000/- (Rupees Three Thousand) per month to the complainant and other litigation is also pending between the parties.

5. As such, considering the aforesaid facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the Trial Court

Patna High Court CR. MISC. No.6390 of 2025(3) dt.09-05-2025 3/3 within a period of six weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheohar, in connection with Complaint Case No. C1-151/2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.

6. It is made clear that as per the assurance given by the petitioner to this Court, he shall pay Rs. 3,000/- (Rupees Three Thousand) every month to the complainant/O.P. No.2 directly in her account. The complainant/O.P. No.2 is directed to provide the details of her account to the petitioner or his counsel for the said remuneration.
