The petitioner seeks bail in Economic Offences Case No. 28/2014 registered under Section 498(A), 498(B), 498(C)/34 of the Indian Penal Code, corresponding to S. Tr. No. 1092/2014. The prayer for bail of the petitioner was earlier rejected vide order dated 10.04.2015 passed in Cr. Misc. No. 45235/2014 with a direction to the trial court to conclude the trial within one year from the date of receipt / production of a copy of that order.

Learned counsel for the petitioner submits that the trial has not yet been concluded but it appears from perusal of the report of the learned Additional Sessions Judge IV-cum-Special

Patna High Court Cr.Misc. No.25390 of 2016 (3) dt.18-01-2017 2/2 Judge, Vigilance (II), Patna that 10 witnesses have already been examined and the trial is at its fag end.

Considering the facts aforesaid, I am not inclined to grant bail to the petitioner in S. Tr. No. 1092/2014, arising out of Economic Offences Case No. 28/2014. Accordingly, the same is rejected.

The trial court is directed to hold the trial on day-today basis and conclude the same within six months from the date of receipt / production of a copy of this order. The Superintendent of Police, Economic Offences, Patna is directed to ensure the attendance of the non-examined prosecution witnesses of S. Tr. No. 1092/2014, arising out of Economic Offences Case No. 28/2014, so that the trial must be concluded within the aforesaid period of six months. Let copy of this order be transmitted to the learned trial court as well as the concerned Superintendent of Police, Economic Offences, Patna for information and needful.
