ANJANA PRAKASH ORAL ORDER 17-03-2016 The petitioner seeks revision of the order dated 12.06.2013 passed by the Principal Judge Family Court, Muzaffarpur in Maintenance Case No. 3 of 2009.

Learned counsel for the petitioner has produced the certified copy of the enquiry report conducted in a proceeding under Section 107 Cr.P.C. It is not clear that the Opposite Party no. 2 is living in the house provided by the petitioner in one room but whether the four other rooms have been given on rent by her or the petitioner is not cleared.

It has been submitted on behalf of the petitioner that petitioner is paying Rs. 8000/- per month for her upkeep and also maintains the house, electricity bills and minor maintenance and

Patna High Court CR. REV. No.594 of 2015 (3) dt.17-03-2016 that the rent is also taken by the Opposite Party No. 2. In such a situation, the application is disposed off with direction that if the Opposite Party no. 2 is taking the rent, she shall continue to do so and the petitioner shall continue to pay in addition Rs. 8000/- per month as maintenance as he is presently doing.
