JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-04-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under section 302, 120(B), 34 of the Indian Penal Code and 27 of the Arms Act.
It is alleged that on the date and time of occurrence all the FIR named accused persons including this petitioner assaulted the informant. On protest, it is alleged that co-accused Sanjay Kumar shot at father of informant which hit his leg. Learned counsel for the petitioner submits that petitioner has been implicated in this case on the basis of confessional statement of co-accused Arun Yadav. There is no specific allegation of any overt act against the petitioner. The specific allegation is against the co-accused Sanjay Kumar that he shot fire at the deceased.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sess. Judge V Barh, Patna in Pandarak P.S. case no.40 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
