JUSTICE MADHURESH PRASAD ORAL ORDER 27-02-2020 So far petitioner No. 1 is concerned, petitioners' Counsel submits that the claim for benefit of scale of Rs. 40006000/- based on parity with petitioners of CWJC No. 17151 of 2018 is required to be considered by the Regional Deputy Director of Education (Respondent No. 3). The claim has been submitted on 18.12.2019.

The issue as to grant of benefits of the said scale has been decided in LPA No. 167 of 2016 by the Division Bench on 23.6.2017. The issue is not disputed by the State Counsel.

Patna High Court CWJC No.2822 of 2020(2) dt.27-02-2020 2/2 Therefore, the writ application in so far as petitioner No. 1 is concerned, is disposed of with a direction to respondent No. 3 to grant the benefits accordingly expeditiously and without any undue delay and preferably within a period of three months from the date of receipt/production of a copy of this order.

In respect of petitioner Nos. 2 to 4, as prayed by Counsel for the petitioners, the writ petition is permitted to be withdrawn with liberty to avail appropriate remedy against the order dated 3.12.2011 passed in CWJC No. 10449 of 2010. (Madhuresh Prasad, J) SNkumar/- U
