The petitioner apprehends his arrest in connection with Kateya P.S. Case No. 10 of 2014 registered for the offences punishable under Sections 302 read with sections 201 and 120(B)/34 of the Indian Penal Code later on Section 2(U) of the SC/ST (RA) Act added.

Earlier prayer for bail of the petitioner was rejected vide order dated 16.12.2014 considering the materials available on record.

In the present application, through no fresh ground is made out by the petitioner for renewing his prayer for bail but supplementary affidavit has been filed by him, from perusal of

Patna High Court Cr.Misc. No.32361 of 2015 (3) dt.26-08-2015 which, it appears that the petitioner was examined by the jail doctor, Gopalganj and after that, he has been referred to Cardiology Department at IGIC, PMCH.

Considering the fact that the petitioner is having serious medical issues, let the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in connection with Kateya P.S. Case No. 10 of 2014. However, it is made clear that petitioner shall cooperate in the trial and shall not make himself absent so that the trial may not be prejudiced in any manner.
