JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-08-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners being parents-in-law of the deceased are in jail custody in a case registered under Sections-304B/34 of the Indian Penal Code.

It is surprising enough that neither the date of marriage nor factum of demand of dowry was disclosed in the fardbeyan of the informant but in spite of that, police lodged the case under Sections-304B/34 of the Indian Penal Code and without taking note of the aforesaid fact, learned court below rejected the prayer for regular bail of the petitioners.

Patna High Court Cr.Misc. No.31364 of 2015 (2) dt.14-08-2015 2/2 Considering the facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Chakai P.S. Case No. 93 of 2014 to the satisfaction of Sri Lalan Kumar, J.M.-Ist Class, Jamui.
