The petitioner is languishing in custody since 03.08.2015 in connection with Malaypur P.S. Case No. 26 of 2015 for the offences instituted under Sections 304(B)/34 of the IPC and 3⁄4 of the D.P. Act.
The accusation is of killing the daughter of the informant and her two sons by the accused persons due to non-fulfilment of dowry demand.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 03.08.2015 and the charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioner. He has got no criminal antecedent. By the earlier order dated 18.08.2016,
Patna High Court Cr.Misc. No.22677 of 2016 (8) dt.23-09-2016 2/2 the case diary was called for in light of the report submitted by the Dy. S.P. (Headquarter), Jamui. The said report was submitted in light of the direction made by the C.J.M., Jamui. In the said report, number of witnesses have been referred who have stated that due to a petty reason, hot exchange of words took place and the deceased committed suicide. Number of witnesses in paragraph nos. 94, 95 and 96 of the case diary have supported the said fact that the deceased had committed suicide. The petitioner has falsely been implicated in the present case.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Jamui, in connection with Malaypur P.S.
