The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 385, 504, 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case got initiated on the basis of a written report submitted by Bhawash Jha before the officer-in-

Patna High Court CR. MISC. No.4598 of 2020(2) dt.29-02-2020 2/3 charge of Bihra, Police Station, is to the effect that on 07.07.2019 at 9.30 A.M., when the informant was ploughing his agricultural field when all the accused persons including the petitioners and unknown armed with firearm came in his agricultural field and starting assaulting the informant. It is further alleged that earlier also, co-accused Bunty Singh, and Om Prakash Singh, and petitioner no. 1 and 2, Prince Singh and Pradeep Singh had come and demanded extortion amount of Rs. 5 lakh and on non-fulfillment of the same, they resorted to fire and took away the crops from the agricultural field of the informant.

It is submitted by learned counsel for the petitioner that general and omnibus accusation has been caused against the petitioners and no one has received any injury in the alleged occurrence and in the background of a land dispute, the accusation has been levelled against the petitioners. Statement has been made in paragraph no. 3 of the petition that petitioners are not having any criminal antecedent.

Learned APP submits that petitioners are named in the F.I.R., with specific accusation.

Considering the accusation levelled in the background of a land dispute, no injury being caused to anyone coupled with

No.4598 of 2020(2) dt.29-02-2020 3/3 the fact that petitioners are not having any criminal antecedent, let the above named petitioners be released on anticipatory bail in event of arrest or surrender within 12 weeks on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saharsa, in connection with Bihra P.S. Case No. 112 of 2019, subject to the conditions laid down in Section 438(2) of the Cr.P.C.
