JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 20-02-2024 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P appearing on behalf of the State.
2. The petitioner has prayed for bail in a case registered for the offence punishable under Sections 341, 323, 324, 307, 504, 506, 34 of the Indian Penal Code. Later on Section 302 I.P.C was also added.
3. It is a case of commission of murder of the father of the informant. It is alleged against the petitioner that he assaulted with butt of pistol on the head of the informant. The other accused persons assaulted the informant and his father. The father of the informant subsequently succumbed to the injuries.
4. It is submitted by learned counsel for the petitioner
Patna High Court CR. MISC. No.7914 of 2024(2) dt.20-02-2024 2/2 that petitioner is innocent and he has falsely been implicated in this case. There is case and counter case between the parties. There is no allegation of assault to the deceased against the petitioner. Other co-accused namely, Dilip Kumar Singh has already been granted bail by this Bench vide order dated 06.02.2024 passed in Cr. Misc. No. 4099 of 2024. The petitioner has got no criminal antecedent and he is languishing in custody since 04.10.2023.
5. In contra, learned A.P.P appearing on behalf of the State and learned counsel for the informant have vehemently opposed the prayer for bail of the petitioner.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IX, Saran in connection with Amnour P.S. Case No.149 of 2023.
