JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-05-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the complainant is languishing in custody since 30.3.2016 in a complaint case wherein process has been directed to be issued after cognizance being taken under Sections 498A of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act.
The basic accusation is of torture for non fulfillment of dowry demands.
It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the complainant and even at present the petitioner is ready to keep the complainant as wife with full dignity and honour. Statement to that effect has
Patna High Court Cr.Misc. No.21810 of 2016 (2) dt.17-05-2016 2/2 been made in paragraph 8 of the petition which reads as follows; "That it is humbly submitted that the petitioner is husband of complainant and ready to keep his wife with full dignity and honour."
Considering the stand of the petitioner, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Vaishali at Hajipur in connection with Complaint Case No. 2925 of 2012.
