The petitioners apprehend their arrest in a case registered for the offence punishable under section 467, 468, 471, 406, 420, 120B and 34 of IPC.
Allegedly, a land was purchased by the father of the informant, who died in the year 2017. In the year 2012 by getting benefit of weak, old aged and mental sickness of his father, petitioner no.2 got the sale deed executed in favour of his wife i.e. petitioner no.1 by cheating other brothers to obtain gas agency from Indian Oil Corporation.
It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have committed no offence.
Patna High Court CR. MISC. No.7995 of 2022(4) dt.26-09-2022 2/3 They have been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation leveled against the petitioners is not specific rather general and omnibus in nature. Informant and petitioner no.2 are own brothers and petitioner no.1 is the wife of petitioner no.2. There is a civil dispute between the parties. The said land is a purchased land and acquired property of the father of the informant and Ranjeet Kumar, who sold out of the said land in favour of petitioner no.1, after getting full consideration money by the registered sale deed upon which the said gas agency is running presently. Petitioners have two criminal antecedent, as also mentioned in para-3 of the bail application. Learned APP for the State opposed the prayer for anticipatory bail.
Having regard to the facts and circumstances of the case, since there is a civil dispute between the parties, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in Kudhani (Turki
