JUSTICE ANIL KUMAR SINHA ORAL ORDER 24-08-2021 Mr. Diwakar Yadav, learned counsel for the petitioner appears in person and contends that Mukhiya, Gram Panchayat Raj, Dhuabai, District- Bhagalpur has not been acting in terms of the provisions of Bihar Panchayat Raj Act, 2006. As such, petitioner being an Advocate and a public spirited person has filed a complaint before the Principal Secretary, Panchayati Raj Department, Govt. of Bihar, Patna for taking action against Mukhiya under Section 18(5) of the Bihar

Patna High Court CWJC No.5400 of 2021(2) dt.24-08-2021 2/2 Panchayat Raj Act and also for taking appropriate legal action against District Magistrate, Bhagalpur i.e., Respondent No.6 for not taking any action upon the report submitted by the Panchayati Raj Department against Mukhiya.

In view of the nature of the relief, learned counsel for the petitioner seeks permission to withdraw the instant writ application with liberty to file public interest litigation in this regard.

Permission is accorded.

The present writ application is dismissed as withdrawn with the liberty aforesaid.
