JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 31-01-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Choutham P.S. Case No. 48 of 2019 for the offenses under Section 379 of the Indian Penal Code.

Allegation against this petitioner is that he was involved in theft of truck.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR. His name surfaced on the confessional statement of co-accused who has been granted bail by this Court. The petitioner is in custody since 17.09.2019. Considering the fact that the petitioner was not named in the FIR and his name surfaced on the confessional statement,

Patna High Court CR. MISC. No.4696 of 2020(2) dt.31-01-2020 2/2 the Court is inclined bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/-(Fifty Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Khagaria in connection with Choutham P.S. Case No. 48 of 2019.
