The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341/342/447/448/323/354/379/380/34 of the Indian Penal Code. Considering the nature of allegation against petitioner Vir Bahadur Sah disclosed in the FIR as well as submission of charge sheet against him under Section 354 of the Indian Penal Code, I am not inclined to grant anticipatory bail to him. Hence, the prayer for anticipatory bail is refused. Other petitioners are carrying general and omnibus
Patna High Court CR. MISC. No.4377 of 2020(2) dt.23-01-2020 2/2 allegation of house trespass and commission of assault and theft. Hence, let the petitioners, namely, Kolai Sah, Baidnath Sah and Dhruv Sah @ Dhrup Sah, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Chanpatiya (Sirisiya O.P.) Police Station Case No.142 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners. The petitioners shall not leave the country without permission of the trial Court.
